Statement

In response to C.R.S. § 24-74.1-101 et seq., Mines states as follows:

Mines does not collect the following information, unless a) required by federal or state law; b) necessary for lawful visa sponsorship, financial aid, or any other university program or activity; or c) necessary to determine eligibility for a government-funded program:

    • Place of birth;
    • Immigration or citizenship status; or
    • Information from federal immigration documents.

Mines will not disclose this information, or provide access to non-public campus areas, unless:

    • Presented with a valid subpoena, court order, or judicial warrant issued by a federal judge or magistrate; or
    • The person of interest (or their parent or guardian) provides informed, written consent.

The Office of General Counsel (OGC) is to be notified in the event information or access is requested for federal immigration enforcement. In response to any such request, OGC will request and document the following information from the requesting authority:

    • The name, agency, and badge number of the person initiating and/or leading the federal request; and
    • A copy of the subpoena, court order, or warrant issued by a federal judge or magistrate.

Mines will promptly share information, as appropriate, regarding a federal immigration authority’s request for information or access to the student who was the subject of the request, or to their parent, guardian, or relative.
